Education Provider Certification  Brian Pate Seminars is certified by the North Carolina Real Estate Commission. The Commission’s address is 1313 Navaho Drive, Raleigh, NC 27609. Any complaints concerning the Education Provider or its affiliated instructors should be directed in writing to the Commission. Per Commission Rule 58H .0204, the Education Provider must provide each prospective student with a copy of the Education Provider’s Policies & Procedures Disclosure (PPD) prior to payment of any non-refundable tuition or fee. The PPD, which is required by the NC Real Estate Commission, outlines Education Provider policies plus the rights and obligations of the Provider and the student. A signed certification that a student received a copy of the PPD must be retained by the Provider.

No student shall be denied admission on the basis of age, sex, race, color, national origin, Familial status, handicapPING CONDITION, or religion, SEXUAL ORIENTATION OR GENDER IDENTITY.

X    the annual Continuing Education courses needed to maintain a real estate license on active status.

Broker Continuing Education Courses

Purpose of the Continuing Education Program

The primary objective of the mandatory Continuing Education Program is to help assure that licensees possess the knowledge, skills, and competency necessary to function in the real estate business in a manner that protects and serves real estate consumers and the public interest.

Per G.S.93A-38.5, brokers must complete eight (8) credit hours of instruction annually in subjects approved by the Commission in order to retain eligibility to actively engage in real estate brokerage. Per Commission Rule 58A .1702, the eight hours must be comprised of an Update course and four credit hours of elective courses.

Course Description(s) .

2024-2025 General Update (GenUp): As required by NC Real Estate Commission for non-BIC and non-BIC-Eligible Licensees

2024-2025 Broker-in-Charge Update (BICUP): As required by NC Real Estate Commission For BIC and BIC-Eligible Licensees.

Elective: Real Estate Trends in the 2020s (3936) This is a 4-hour elective course that walks students through the current and future direction of the real estate business and how it affects that way consumers are impacted.

Elective: If You List, You Last (1860,1861) This is a 4-hour elective where attendees will be able to apply concepts to improve listing skills. The course covers the pre-listing process, the active stage, contract to closing and post-closing techniques.

Elective: Investors Assemble! (1882, 1883) This is a 4-hour elective course teaches attendees to set up a business plan for consumers, give students a better understanding of the basic principles of investment, how to utilize tools that are available, practical case studies and investment models, understanding the investor’s motivation, short term rentals vs multi-family vs long term rentals.

Elective: Cons, Scams and Hacks (1925, 1926) This is a 4-hour elective course teaches attendees how to prevent email hacks, operate artificial intelligence in accordance with NC Real Estate Commission law and the NAR Code of Ethics, and how to prevent wire fraud.

Elective: Ethics in Real Estate Advertising (1925, 1926) Ethics in Real Estate Advertising is a four-hour continuing education course approved by the North Carolina Real Estate Commission and meet the 2.5-hour requirements of the National Association of Realtors for ethics.

In this course, attendees will do an in-depth study of the Code of Ethics including the Preamble, and eight different articles and standards of practice. Along with that, attendees will be able to compare and contrast the Code of Ethics and the rules of the North Carolina Real Estate Commission. Inside this course are tips and tricks for licensees to use to make their marketing compliant with both NAR and NCREC rules for your social media advertising, Zillow, Realtor and Homes profiles.

Course Materials

Brian Pate Seminars will provide each student with a copy of course materials. In person, students will receive a copy of materials at check in. For synchronous courses, students will receive a copy of the student manual the night before class.

Eligibility Requirements for Course Completion Certificate

Per Commission Rule 58A .1705(a):

In order to receive credit for completing an approved continuing education course, a broker shall:

(1) attend at least 90 percent of the scheduled instructional hours for the course;

(2) provide his or her legal name and license number to the education provider;

(3) present his or her pocket card or photo identification card, if necessary; and

(4) personally, perform all work required to complete the course.

Tuition: All tuition and fees for courses are all inclusive and are as publicized on the Brian Pate Seminars web site. Brian Pate Seminars will provide all required materials for each class prior to the start of the course.

Registration, Enrollment, and Conduct

Registration

To enroll in a course at Brian Pate Seminars, prospective students must have access to a computer.

For courses taught using the Zoom format, attendees must have a his/her own Zoom account and continuous access to an internet connection throughout the course. Attendees must also have a video camera on their computer or tablet for continuous video feed to the instructor. No student may attend a course via cell phone while in a moving vehicle. If necessary, a student may attend from a stationary cell phone, but the experience will be limited on Zoom for attendees including chat and annotation functions.

For in person classes, attendees will not be allowed to have a laptop or tablet open during the teaching time. Cell phones may be required from time to time for in class exercises. In person students must be actively engaged in the class and cannot be doing other activities including paperwork, email communications, texting, etc.

Tuition and Fees

Brian Pate Seminars accepts the following forms of payment: _Paypal, Mastercard and Visa. Venmo, Cash or checks may be accepted for “walk up” students for an in-person class. For Zoom format classes, registration will be closed at 4pm Eastern Time the afternoon before the class. Tuition must be paid in advance. The penalty for a returned check will be $35 if returned for insufficient funds. Failure to remedy the payment will result in no credit being given for the course.

­­­­­­­­Attendance

 Brian Pate Seminars will adhere to the following policies as required by the North Carolina Real Estate Commission for Attendance:

  • Students in an in-person or synchronous distance learning Continuing Education Course can miss no more than 20 minutes of class.
  • Early departures from CE courses delivered in-person or via synchronous distance learning are prohibited by Rule 58A .1705. Attendees may not miss the last 20 minutes of class.
  • Attendance will be closely monitored, including late arrivals and early departures from class sessions and from all scheduled breaks, during in-person and synchronous distance learning courses. All time missed will be recorded for each student.
  • Students may not attend a class via cell phone. Students must be logged into a desktop, laptop or tablet. Students may NOT attend a course or receive credit for a course while riding in a vehicle. If a student is found to be in a vehicle during the class, the student will be removed with no credit and no refund given.
  • There will be a moderator in any class with more than 25 students to assist the instructor with enforcement of these requirements.

 

Course Cancellation or Rescheduling / Refunds

Brian Pate Seminars reserves the right to cancel or reschedule a course as needed.  Students enrolled in a rescheduled or cancelled course will be given a minimum 24-hour notice of the cancellation or revised course schedule.

If a course is cancelled or rescheduled, students may receive a full refund or transfer to another course offered by Brian Pate Seminars.

Withdrawals and Transfers / Refunds

 A student may withdraw from a course by giving written notice to the Education Provider 48 hours prior to the start of the course. In such event, the student will have the following options: 1. Receive a 100% refund or 2. Transfer to another Brian Pate Seminars course.

A student who terminates enrollment in a course either with written notice to the Education Provider or by no longer attending a course on or after 48 hours prior to the scheduled start of the course, will not be entitled to a refund of any portion of paid Tuition.

Student Conduct

Students may not use a cell phone to attend class in a moving vehicle.

Students are expected to be respectful at all times of their instructor and their peers.

For synchronous courses, all students should keep their webcams on at all times during course instruction and keep their microphones on mute unless talking about relevant course material to their instructor or peers. Be respectful when using the chat.

Disrespectful students will be immediately dismissed from the class and forfeit all tuition fees.

Any time that a student is away from their webcam or caught sleeping will count towards missed class time.

Use of phones is strictly prohibited.  Any student that is on a phone will during the class time will be marked absent for that period of time in which he/she is on the call.

Students are not allowed to use their computers during class time for any purpose that is not relevant to the course.

Special Accommodations Request Procedure

Brian Pate Seminars complies with the Americans with Disabilities Act (ADA) and strives to ensure that no individual with a disability as defined by the ADA is deprived of the opportunity to participate in a course. Students requesting special accommodations must notify the Education Provider via email at brian@brianpateseminars.com a minimum of 3 business days in advance of the course.

Inclement Weather 

In the event of inclement weather or a local or national emergency, Brian Pate Seminars will communicate with students regarding scheduling adjustments. If the class is being offered in person and there is inclement weather, Brian Pate Seminars reserves the right to change the class to a synchronous class via Zoom.  In those cases, when a student does not want to participate via Zoom, refunds will be given in full.

Course Schedules

Course schedules are published separately from this Policies & Procedures Disclosure. Schedules are posted on the Education Provider’s website brianpateseminars.com and are also available upon request.

Use of Technology in the Classroom

Brian Pate Seminars is not responsible for lost or stolen electronic devices.

Brian Pate Seminars will provide wireless internet access for in-person classes when available. Students should not depend on WIFI being provided in a classroom. If wireless Internet access is provided, the Education Provider is not responsible for disruptions in or problems with the service.

Brian Pate Seminars DOES NOT allow the use of laptops, tablets, and similar devices in the classroom. Cell phone use will only be permitted when part of classroom instruction. Sound on any electronic device must be muted during class sessions.

Classroom courses at Brian Pate Seminars are open to enrolled students only. Enrolled students may not bring visitors to the classroom without prior approval of the Education Director.

Cheating

If a student is discovered to be cheating in any manner during an examination, the student will be immediately dismissed, will receive a failing course grade, will not be eligible for any retake or makeup policies, and will be reported to the NC Real Estate Commission [per Commission Rule 58H .0203(h)].
